Got my third speeding ticket going 37 in a 30(most people go around 40 on that stretch of road). Got my first ticket last summer and took defensive driving class to dismiss it in october which means I can't take defensive driving to dismiss my third one. It has been over 6 month since my last ticket (the second). Is there any thing I can do to get the ticket dismissed/no record? Thanks.

if you took the class to dismiss the first ticket last october wait until this october and take the class again to dismiss this one.
you can take one class a year to a total of five in your lifetime

ps believe me I know, this oct you are eligble to take the class again.I wasnt as lucky...

Well, I would venture to say you should make sure about the regulations in your state. They may vary. For instance, here in California you are only eligible for driving school once every 18 months. I would suggest you fight that one. 37 in a 30 seems like a frivolous ticket.

Get a lawyer, he or she can reduce your speeding ticket to a parking ticket.

What? In which of the fifty states can a moving violation be converted to a stationary violation?

Well, here in miami everytime I had tiket,I had alway go to tiket buster.I know for a fact that everytime you send a lawyer for you to court, you wont get any points in your license. The worst that could happen is that you lose the case and then, the only thing you have to do is pay for the tiket and court spenses.but you never get any points in your license.

In California you are allowed to go to traffic school more than once. You need to see the judge and ask for the 12 hour course. The difference is that the ticket stays on your record but there is no point value assigned to it.

The Constitution of the United States allows self-representation in a court of law.

But ask yourself this question "Will I know exactly what to do during the procedure, just like a schooled lawyer does?" I'd bet the answer is "no" so just go hire a lawyer to maximize your chances.

But I got the ticket on August the 2nd. Are you saying that it's possible that I can wait until October to take the class to dismiss a ticket that I got 2 month ago?

Let's see.....BadCarma lives in Florida and you live in Texas. Shouldn't you be consulting with someone educated in the laws of Texas vs what people from a different state suggest? Wouldn't you appear foolish to a Texas judge, acting on the suggestion from someone out of state, only to find their advice does not apply here?

Besides, BadCarma's "five per lifetime" statement about defensive driving classes in the State of Texas is VERY wrong.

Guys,

It really is not about "what to say" or "what not to say". It's about who you know and who can negotiate. A lawyer well versed in this (and well connected) will know the judge and the officer involved, and any change(reduction) in a ticket or fine will be taken care of way before the court date.

I have seen this happen in one 2 minute phone conversation. I was once asked to "fax" the ticket to a lawyers office and consider it taken care of!

I have talked to many folks "in the business" and this is how it's done. Get a well connected lawyer, pay the money, and back off to keep it from happening regularly.

I live in Texas...

You have a couple of options, most of which include getting a traffic lawyer. Usually the cost for the lawyer is close to the fine but they get it dismissed. I have used 2 lawyers (one in houston and one in college station). They have multiple ways of getting you out of the ticket. Besides getting it dismissed for your officer not showing up/etc. You can get defereed adjudication, where if you don't get another violation in the next 3 months your ticket is dismissed, the only money you are out is court fees. Sometimes the judge will allow you to take defensive driving even though it hasn't been 12 months, you can even reschedule you court date so that it is 12 months by the time it comes around. My advice contact a traffic lawyer, shouldn't cost you more then the ticket and will most likely get if off your record.

I know in california you can ask for traffic school as many times as you want. I think the section code is 40801 or 41501- and it states if the judge lets you take it again, then its ok to.

I had a college frind who went 6 times in 18 months. never hit her record.

In Cook County, Illinois, you can now take traffic school over the Internet from the comfort of your own home. Ask me how I know...

I bookmarked it in the "Favorites" of my browser, just in case.

The on-line school was developed by the Center for Public Safety (yeah, right) of Northwestern University. It appears that they have constructed their website in a way that will enable them to sell it to other states and jurisdictions as well.

I'll look up/contact a lawyer first thing in the morning tomorrow. Anyone that lives in the Round Rock/Austin area of Texas knows of a good firm/lawyer to go to?

Funny thing is my wife got a ticket a few days ago for running a red light and she got a letter two days later from a traffic lawyer and a defensive driving school. Looks like the city of austin sells info out on who gets a ticket.

I have never used them but have heard the best traffic lawyer in Austin is Deirdre Darrozett.

Do you have a radar detector? I know they aren't 100% protection but has saved many times and has paid for itself many times over. I suggest the V1.

that is a shame, cops here in california tolerate up to atleast 10 mphs over. the cops over there must not have anything to do.

This is the best advice. It is also how it works in the town where I live. I just faxed a ticket yesterday and poof it disappeared.
