Well, I bet the guy won't be spray painting anybody's cars anytime soon. That being said, assault is a much bigger deal than vandalism and I doubt that cocky little punk could justify his actions in court. He'd be the one going to jail I think, and there's a reason for it too. There's no justification here to attack anyone, and those of you on here who agree that the kid was entitled to assault someone over spray paint on a car need to re-evaluate your perspectives - what if he had a medical condition and he died while the kid was beating the crap outta him?

Very well said. This kid is a douche. I have no doubt in my mind that he will get his ass seriously beat in the near future with an attitude like that. The Vet was wrong and admitted his mistake and accepted responsibility. That kid needs to learn to respect people and keep things in perspective.

This. I'm really not sure how I would respond, but this kid is wrong. I still believe that men can handle their problems outside of court and maybe this ended the best way possible but talking shit on video about how you beat up an old man? Not smart. The kid legally stands to loose the most.

Imagine your the kid and it is your day in court- how do you explain what you did? It wasn't self defense- for self defense you have to prove your application of force was reasonable to establish your safety.
Even if the Vet spit on this guy, or "put hands on him" it doesn't justify the application of force- especially when there is a video of the "attacker" being contrite while the "defender" taunts, and berates him.
Over what? A car? What jury is going to see justice in that?
This was a clear cut case of assault. How stupid can you be? (both parties)
As has been said- 2 wrongs don't make a right- and even though I abhor the idea of someone defacing someone elses car for ANY reason, I think the kid who made the video is the more guilty party here. Any court will see that.
And the sad part is the (real) victim (car owner) might go to jail for beating him up

This might be a little difficult to say. It's probably going to come down to a "he did this first, no he did this first" police report if there were no credible witnesses.
The vet looked like a racist skin head. Fit the bill pretty dam good. State laws may vary but here in California if the racist man did indeed spit and then lay his hands on the EVO owner first then that is assault - twice and grounds to defend oneself in preservation of life and limb.

As I mentioned above, if the racist did indeed spit and lay his hands on the EVO owner, and the owner acted in self defense then I can't see how he is in the wrong. Sure he said a few words, but that's understandable from the heat of the moment and won't land him in jail for the words. We're in the USA not China.

The Vet was the bigger guy. And looked fuglier and scarier. His skin-head appearance won't do him very well in court when the multi-race jury sees just how scary he looks. Sure there will be "evidence" presented, but the jurors are human too and will feel the chills down their backs when they see a skin-head in 3D.
The key here is that the Vet allegedly assaulted the EVO first. and the EVO acted in self defense. I don't see it as a more solid case for the EVO guy's favor so far.

Here in Cali spitting is a form of assault that falls under "Application of force"
"Application of force" means any touch…no matter how slight…if the touch is done in an angry, harmful, or even offensive manner.
The contact can be through one’s clothing or even indirectly through an object or another person. The physical contact doesn’t have to result in any pain or injury. Simply "spitting" on another would suffice.
It bears repeating that California assault law does not require that you actually make physical contact with another person. All that is necessary is that you have the intent and ability to injure that individual.
Example: You took a swing at BATMANs, but missed because BATMANs"ducked". Even though there was no contact, prosecutors could still charge You with Penal Code 240 PC assault. If BATMANs hadn’t ducked, Your act of "swinging" would have likely resulted in an injury.
The bright side is that the kid gets a BATMANs-grade pressure wash, full clay bar, Zaino ZP-C, ZAIO, Z2 and Z8 detail work and the EVO looks better than it really does.

We only saw the aftermath of the incident with the vet's bloody face, so it's easy to have some sympathy for the guy. We don't really know what went on before that. If the owner of the Evo is a 3 foot midget Asian woman, I bet the vet wouldn't be apologizing and took "responsibility"!!

Neither party deserves any respect for what occurred. If anything, I agree with the following sentiment:

This reminds me of the case back in the 80s where a criminal broke into someones house and when the homeowner beat his a$$ as he said he was leaving their home (didn't know anyone was home) he criminal was able to sue the homeowners (insurance) and WON!!!
This is the problem with our legal system....most of us on here are looking at the fact that the car owners' degree of violence exceeded the level of the initial crime...this is how criminals are finding legal loopholes in order to exploit our legal system. (Not saying this is what will happen)
I think we are all getting caught up with the fact that this guy is a "vet" and not a person who committed a crime. I am not justifying the car owners behavior.
We need to look at this guy as a criminal....same as if he was wearing baggy pants or a hoodie.
