Got scammed, anyone in Reno/Tahoe area willing to help?

Ok, well this is an odd favor, but here is the story.

I bought my car off of this dude in Reno, NV. Part of our agreement was that he would cancel the extended warranty and refund me the money that Acura Care would send back to him. He said no problem since he was selling the car with the warranty, and based on our deal it was my right to have it back. This amounted to ~$1,660.

I thought no problem, this guy wouldn't scam me. He is a very wealthy real estate investor, plus the CEO of a large corporation out there. mature, 40ish years old, nice guy. Once the car was sold, things changed. I bought the car in May, and every few weeks I would send and email and ask about the status of the refund. He would avoid my emails, and avoid my calls. at one point he just began hanging up on me, and when he did pick up, he said to never call back, neve email him. this guy turned into one real jerk.

well now it is October, and I feel like crap, not only because I am out $1,660 that is rightfully mine, but also because someone like this is getting away with essentially robbing me.

I would like to get the money back. I am not local, so it is hard for me to go to the guy's door to "collect."

anyone have any decent ideas? anyone willing to help? if you have any creative ideas, you can even PM me.

Your thoughts and help would be appreciated.
 
I am not a lawyer, but I did stay at a Holiday Inn Express last night!

Probably have to take it to small claims court. Best bet is to talk to a lawyer from that state. You may have to actually show up for court to collect. Maybe you can have a proxy so you don't have to travel.... talk to a lawyer. At least you have it in writing, which is the big plus.

try talking to a lawyer and ask them to write a demand letter for you. provide them with a copy of whatever paperwork you have and explain your story. a demand letter will often get people to rethink their shady actions. it shows you are serious about the situation, but it does not cost much up front.

my wife is a lawyer, i will ask her tonight what the best recourse is...

This is an unfortunate situation. I find it weird you didn't just subtract the warranty refund from the sales price up front. That way when the money came back he would just keep it. Seems much easier.

OK got the scoop...

a demand letter will probably cost a bunch, unless you have a friend in the biz...

the easiest recourse is to get online and look up the justice court in the area where you bought the car. get the phone number and ask them if there is paperwork online to file a complaint and summons for small claims. file the paperwork and wait for a response from the other guy. they will then set a date for a hearing. you can request to attend the hearing telephonically, meaning no travel, but may not get it. all in all, this costs no lawyer fees, but may require travel to reno...

i'd say that isn't bad because is you take the X, it would be a fun drive anyway!!!
