Took delivery yesterday and guess what?

I'm on my way home from taking delivery of a 98 Spa Yellow Targa and I'm literally minutes from home and this lady cuts me off, I brake but her rear quarter is about to hit my precious aluminum so I try to carefully swerve but I'm next to a curb which my rear wheel hits and give it some rash and a nice blemish on one of the spokes. I was furious.

I made her pull over and she acts clueless. Call cops and although her story had all sorts of loopholes clearly indicating she was at fault, with no hit and no witnesses (man I wish I flagged a couple down) the police have no opinion. So now I'll likely have to have the wheel refinished on my dime since its not worth it to put in a claim.

I had planned on adding wheels but now I want to do it even faster. I was still overjoyed that there was no body or major damage at all.

Now that yesterday is over I can continue to bask in the light of my yellow jewel. I've had 2 93 red cars which you can see one of them in my site below. However a yellow full comptech car lowered on Fikse's is the NSX that made me fall in love with the car and I've wanted one ever since. So after Viper GTS, Z06, 993, and more I'm back where I knew I'd eventually (I had planned on returing with the new car but it took to long). I realize that I missed NSXpo by 2 weeks. Funny thing is that when I sold my last one i missed the one in my area (Dallas) by a few months. Oh well... Let the mods begin.

Didn't come from Austin. Was a Dallas local trade on a new Lexus. On the wheel, it rides smooth at all speeds and also in the refinishing process they propery true the wheel anyhow.

I'm likely not going to spend the 100 now. I'll get a new set and while these are laying around I'll send this one off.
 
Congrats and welcome back! Sorry to hear about your incident, but it could have been worse. Make the best of it and be careful! How could she not see that yellow beast!! :D

on the real note, you got to be blind to not see a yellow car.
 
She had gotten out of my lane into a lane of more traffic and as I was about to go past because my lane had none she suddenly decided she wanted back in my lane and wanted to turn. She should have checked first and have been surveying the field anyhow. Oh well... I understand people make mistakes which is why they are called accidents.

What pissed me off is the principle more than the wheel (it's just a thing). Its the fact that she completely denied that she cut me off. She told the cops that she was just cruising and had no idea anything happened until I asked her to pull over or I'm going to call the cops. I hate when people are so dishonest and crooked that they lie to cover their but. But thats the world we live in right?
 
Congrats on your purchase and sorry to hear about that incident.

It's amazing how many bad drivers there are on the road, you just have to keep your head on a swivel because you never know if someone sees you.... i always assume i am invisible to other drivers which i learned when i used to commute on a motorcycle.

I actually seen someone reading a newspaper while driving on I-95 the other day. They just had a big ole paper sprawled out on their steering wheel.... needless to say the guy wasn't doing the best job of staying in his lane.

btw, where is Frisco? r u gonna go to tws on the 16th? A bunch of TX NSXers r gonna take a nice drive from all over to meet up. It would be a great way to break her in.:cool:
 
An old lady just blindly cut across my lane and hit me on the front fender of the passenger side. Her insurance paid for it, but I will be without the car for a while. Pissed me off. Her excuse, "She didn't see me."
 
The sad part of the driving situation is that you don't even need to be moving to get hit. Just after taking delivery, I was sitting in line at a gas station and the guy in front of me decides to put it in reverse. He came up onto my front end and did 16k worth of damage.

Mark, not trying to be funny. But your car may be jinxed.
2 accidents, major curb rash. I would be wondering about now.
But again, at least yours is running.

I was recently in an accident as well. One month ago I was on my way to work in a company car (Suzuki Verona) heading west when an eastbound Taurus turned right in front of me. I hit the woman at about 50mph, and broke both bones in my right leg on impact. She walked away unhurt. She never saw me, never even applied her brakes, and was not wearing a seatbelt. The police said "you just ran into a 73 year old woman who shouldn't have a license". I have been confined to home since then, and I'll have a rod in my right leg for the rest of my life. I have another 6 months before i can expect to make a full recovery of the leg, and probably 2 years before the cartilage in my knee recovers from the damage caused on impact with the dashboard.

I'm glad that a broken leg is the worst injury to come from this accident. I was told that, based on the condition of the car, I should have died. And the woman who turned into me missed a light post by about 6", which would have thrown her through the windshield.
 
Why are you not making a claim under her insurance policy? She caused damage to you due to her negligence. Even though there was no contact between the cars you can still make the claim. I've been working in the insurance business for a long time and my wife is a defense attorney. What's the worst that can happen? Her ins. company denies your claim. So what. You haven't lost anything. The trick to these kind of claims is strike quickly and be convincing. If you wait too long the company will have question as to who was really at fault. They will ask if your so sure that she was negligent, then why did you wait to file a claim. I'm gald to hear nobody was injured including the NSX but the fact remains that her negligence caused your damage. I've seen stranger cases/claims won. Good luck!

I have a lawyer working on claims right now. I was in contact with my lawyer within 2 days of getting out of the hospital.

And, sadly, I don't own an NSX yet. But i am glad that it wasn't one of my cars that was involved...
 
The NSX will come. You know I share your feeling about accidents.
 
The very next day after getting my NSX I was making a left turn onto a city highway, pulled into the far left lane (as I should), and started to accelerate this wonderful new (well technically used) car.

Suddenly I huge white ford doully (however those bick nasty trucks are spelled) comes out of a gas station blows across all 3 lanes and is about to literally run me over. I slam on my brakes, just as you did, and rubbed up against a curb.

Now here is the irony. Like you I had to force her to pull over. I approach her vehicle and she says to me "You better get you ass back in that little car Boy, you don't know who your messing with!!" at which point she pulls out a police badge. I smile and say "thats neat, lookie I have one too, but that doesn't give me the right to drive like an asshole". She is a sheriff so she has full jurisdiction where as I am just a city cop out of my jurisdiction. Of course, jurisdiction is irrelevent for the issue at hand. But, she was clearly an ingorant redneck that felt that I had no claim simply because I was "out of my jurisdiction".

"fine" I said. I jurisdiction is so important, I will get the appropriate police here". I call my brother who is a homicide detective who has jurisdiction in that area. He sends a motor patrol unit (bike cop) by and the cop said what I painfully already knew: "If there are no independent wintesses and no clear damage between both vehicles that may give the officer some clue as to what happened, there is nothing he can do other than speculate on a report". Of course there is a nice big confederate flag on the front of this woman's bumper. Shortly thereafter, she calls her hubby who also happens to be a cop. I think he talks some sense into her though as she shut her mouth up. Perhaps he realized how close she came to smashing the side of an exotic and very hard to repair car.

Long story I know. But it doesn't seem fair that you have to come out of pocket now. Think of it this way, you and the NSX reacted quickly to avoid a potentially bad situation. Well done; and congrats on your new beautiful yellow beauty.

If you scrape the curb, there's no proof at all that the other person made you do that. Then it's on you to either pay for the wheel out of pocket or risk filing a claim.

If you let them hit you, then there's no denying who was at fault... they pay for their mistake! But, you risk injuring yourself or others and you damage the body of your aluminum beauty. And you have to go against your primal instinct of avoiding contact with another car.

You make a good point. I agree this is a tough situation. However, (I can only speak for Maryland law) you don't have to make contact with another vehicle to make a claim. It is ALWAYS best if you can possibly get a witness or a tag number but if not get a police report. If they won't come to the scene, tell them you are hurt. If you are able to get a tag number it's very easy to find the owners name. address, and insurance info. Their insurance company will have to investigate. In most cases when confronted these people admit being at fault. Trust me, they don't want to stand in a court full of people and try to lie. Although it can be very amusing. Sometimes they lie and get away with it. But if they do, what have you lost? Your just back to original plan of fixing the car out of your own pocket.

If you do get in one of these situations and let's assume the at fault person leaves the scene. You can make an uninsured motorist claim which should not have any adverse affect on your policy or record. The reason I am saying this is because I see this crap happen all the time. People paying out thousands of dollars because of the negligence of some a-hole. And I strongly feel that if you damage someone because you can't drive worth a shit, you should pay for it.

God help the person if my family or I get hit. Not to mention if they hit my NSX.

I assume you are joking but if you really did do this..... do you think she really cares about having one of her wheels scratched? she'll probably never notice or worse, the car you damage might not even be hers, it could belong to a boyfriend/husband.
