Street racer to be deported

I don't understand - why isn't this a crime that has to be prosecuted first? Any Canadian lawyers present?
From the article.

The criminal trial judge found that Bhalru and Khosa were street racing before the fatal crash. Bhalru was believed to be the first person in Canada to be convicted of such an offence as a participant in a high-speed fatal race.

The two received a conditional sentence of two years less a day house arrest, three years of probation and a five-year driving prohibition.
Looks like he was convicted, did his time, and is now being deported. I don't feel a bit sorry for him.
