I have a cousin who attends UCLA. She was rear ended on the freeway and needed an Enterprise rental car for a few weeks. While she was driving the rental, she was rear ended by Ken Robin, the douche bag in the link above.
The folks at Enterprise stated that they would take care of it and collect the money to repaint the bumper from Ken Robin. The price for repainting the rear bumper came out to a very reasonable $360. Though Ken agreed to pay the $360, he is now avoiding all calls and I believe he was not covered by his insurance at the time of the accident. Enterprise is now telling my cousin that she will have to fork over the $360 if they cannot collect the money from him by the end of the week.
Should my cousin make another claim to her insurance company for this accident? I don't understand why Enterprise would not point her in this direction and are instead asking her for the money. Will her insurance premiums go up since this is a second accident within a short period of time (albeit both not her fault)? Her record has otherwise been spotless.
Should she report this clown to get him to pay? How would you do it?
Personally, I'd give him a $360 fist massage, but that wouldn't help my cousin.
Thoughts?
