Did you purchase the insurance??? I"ve gone through this before... there is grievance or some junky form that you fill out. Then they dispute it for a bit then paypal makes a decision. Kinda sucks because I bought a playstation 2 and when I received it, it was broken with the void sticker all over the tab. I was rather upset b/c then it became a "Purchaser is trying to get one over on small business." type thing.
Then I started thinking.. you could sell broken ps2's online all day long and no one can prove that you're being fraudulent b/c it becomes your word versus theirs. Really sucks.
Not to be the bearer of bad news but unless you have a relatively strong case... you may be eating the costs.
But if you decide to dispute... logon, go to the bottom.. hit security center, then go to buyer complaint process
Yes, it's possible to get your money back. First thing to do is go to your "Resolution Center" in your Paypal account web control panel. File a claim and wait. If you don't get satisfaction there is still a way, but it will cost you your Paypal account, and there will most likely be a few other issues to deal with.
I recently called Paypal to ask exactly this same question as I had bought a Dyson and wanted to know what would happen if the seller turned out to be a fraud. I know that when purchasing via a credit card you at least have your credit card company to fight for you, but as a premier Paypal member that pays via a checking account, do you have the same protection?
The answer is yes. As someone mentioned before, they have a 30 day guarantee that if you do not get your item and it turns out to be a fake, you do in fact get your money back. The insurance that they offer has nothing to do with whether or not you get the item. It has to do with receiving the item and not being satisfied. The insurance is set up to protect you under these circumstances. If you flat out don't ever receive the item, you are always protected with Paypal if under 30 days.
What happened here? I think I have found myself in similar circumstances - unfortunately with my most expensive purchase to date on eBay (a laptop).
I paid via Paypal, charged to my CC. Hopefully I'll be protected, but have never had to navigate the process before so I don't know exactly what to expect.

I could be wrong, but... I don't think there is any obligation by the seller to make contact after payment, only to ship the goods. I think it's reasonable to allow 2-3 days for the goods to be shipped, plus whatever shipping time would be appropriate based on the location and shipping method. If I didn't receive anything after a couple of days beyond that point, I would try contacting the seller for a status update. And keep that 30 day limit on the guarantee in mind, so that you try resolving it but don't go beyond that limit before filing a complaint.
