Inmate sues jail?

I rented an apartment to a Prison guard. On our rental application there is a question, have you ever been or now a party to a lawsuit, or something like that. His answer was...Yes, several..inmates just lovvvvvve to sue me. :biggrin:
 
I watch with total fascination at the incredible number of stupid lawsuits that are reported from your country... COME ON!!! the dude was in PRISON ffs... now he is suing because he CHOSE to excape???
It beggars belief.

By that logic, I should be suing Bill Gates for inventing the personal computer because of the grief I go through when my system goes down...

Not a problem. I am so tired I can't sleep. Drove and rode ~12 hours today. I had to go back and read poohbears post a few times to make sure I got it right.
 
You know, I am sure that the majority of facilities (jails and prisons) across the nation treat their inmates well enough; unfortunately, there are some who treat inmates as sub-humans who are there for their (guard's) amusement and they do nothing but tease, toy and taunt them all day. So in those situations I am glad the inmates have some vehicle to present those issues where they are reviewed by outsiders.
Now, having said that, I also do not agree with the multiple lawsuits being filed and reviewed becasue the carrots were not cooked to their liking. Can we reach a middle ground here?

Boy you are so wrong its funny to see peoples perception of prison they have no clue how the work or what they are like. Do you feel that a person that raped and murdered 15 innocent people shot them in the head execution style should be treated with respect and decency? How about a person that takes his five month old baby buy the feet and slams it into a wall head first because it would not stop crying. or better yet a person that murders his entire family--when they ask him why he says because they were home. this is the type of people correction officers have to deal with on a daily bases. Manipulative conniving scum of the earth. So sorry if i don't agree with your bleeding hart opinion because you my friend have no clue. every Correction officer I have worked with deals with inmates a firm fair and consistent manner. That is how it has to be!! (There are exceptions as with in any career)

They sue because the state never goes to Cort they settle even if they the state is not guilty of any wrong doing its easier to pay out small amounts then to got to Cort and fight it. So inmates in for the rest of their life, spend their time in the Law library trying to get over on the state. To send money home to their families to buy designer jeans and chrome wheels on there leased SUVs :rolleyes:
 
As someone who spent over 16 months in federal prison, I PROMISE you there are guards and administrative staff who abuse their powers and go out of their way to make life miserable for specific inmates. I was one of them. I spent a month in solitary and didn't see my wife for 4 months all the while being told that I was being brought up on new charges and that by the time I got out, my wife would be in, all because they didn't like her website/blog. My wife contacted the white house and my attorney, they contacted the DOJ (yes, I was surprised they did something as well!!) and an internal affairs investigation was opened. Let me tell you that didn't go over too well, it led to inferred violent threats against me by the warden's right hand men, but eventually it did get my wife back on my visitors list and they moved on to their next target. After I was released from solitary, I found out they told the rest of the inmates I was a rat. Dealing with that sucked about as bad, I was about ready to voluntarily go back to solitary. That was just me, I saw things like this constantly. Just about every week, someone was being screwed over by the prison's SIS (special investigations) group. Even prison staff were afraid of these guys. When I went to solitary, the guy who brought me my meals was someone who I had known and that had 'vanished' months before. I thought he had been transferred to another prison. Nope, they just held him in the 'special housing unit' (solitary) for 6 months. Yeah, he had something coming to him even though they had no proof, but because he wouldn't admit to having contraband brought in (Kentucky Fried Chicken), they messed with him big time.

I was in prison for.......... copyright infringement. You know, not every one in prison is there for murder and rape. In fact, the majority of inmates are not in for any sort of violent crime.

A little actual experience goes a long ways. Prisons cannot be a place to store criminals until they die. If you treat inmates like $hit what do you think their mind frame will be when they get out? The vast majority do get out you know. If the state actor in prisons uses curruption, breaking the rules with power, force, and fear, what tactics do you think released inmates will use? Enhanced team work and communication? I do not think so. Based on a few friends that have done time, it's difficult not to use the ones they are taught while in prison. I don't blame them.

I'm glad robr had the courage to speak up. As soon as someone is viewed as a criminal they are seen as subhuman without any rights [or hope] instead of someone that needs education or therapy. There are many people in jail that aren't serial killers or rapists. Based on my business experience, ANYONE with enough bad luck could probably do some substantial time, myself included, if every little detail about their taxes, driving habits, etc. was suddenly known. I wish our prisons were more productive places and after I make mine that will be one area I focus on.

You are making an assumption, and as usual when one makes assumptions, you are wrong. I am intimately familiar with the CDC system and many CO's. I have personally arrested more than one CO on drug charges in my former career. I also would put to you that we are a civilized society and that the majority of the inmates in the CDC are pretty much regular people who make a mistake. Does that mean they deserve to be beat and raped while serving time? Does that mean they should not be afforded basic human dignity? The percentage of people who act as you describe above are actually few and far between. So these "conniving scum of the earth" as you put it, could be a neighbor, family, friend, co-worker. And, BTW it is not "hart" it is "heart".
And, I would opine that if all CO's dealt with inmates in a "firm, fair and consistent manner" we would not be having this discussion. But then again, according to you, I don't have a clue-(just over 33 years in the CJ field on both sides of the Game). So, here is hoping that no one you know ever ends up doing time-
 
Another thing:

Once someone becomes a prisoner, they are "entitled" to certain treatment. A prisoner is his captor's responsibility. The captor is responsible to care for and protect the prisoner.

The purpose of a jail/prison is to isolate idividuals from society, whether for disciplinary reasons or for the public's sake.

Now, inmates on death row perhaps spend a bit too much time in prison prior to their sentence being carried out, however, I have heard of cases where people sentenced to death were exhonorated in light of new evidence (and therefore released prior to being executed).

In any case... correctional officers who abuse are no better than criminals themselves: the criminals ARE serving their sentence, which does not include abuse by prison guards. Now, if the inmates get rowdy, they should expect some rough treatment. THAT'S what the guards are there for: to ensure the safety of all the inmates, and to intervene with violence if necessary. (It's interesting to see the reaction of certain other countries' police forces when this is explained to them...)
