i thought it was innocent until proven guilty?

o.k. to make a long horrible story short i was cited for doing 55 in 40 a and the judge although the case couldn't be proved he still said guilty and this is were it sucks because my driving record isn't the best but not that bad recently. He decided to revoke my licence for 90 day, give me 20hours of comunity service, said i have to go to the advance driver improvment, and pay $330 in corut cost all for doing 15 over what the hell is wrong with americas justice system. i also have never been in a wreck just carless tickets that it my license has only ever been suspended once

please help

Ahhh that sucks!

While I don't recommend this, in the past, its your right to get a calibration report that shows what type of gun was used, when the officer was last in training to use it, etc.

If its a questionable case as you say, I'd make sure to do this the next time around. Sometimes, if there is a problem in this area, the request will get lost in the shuffle and the case could be dismissed if you challenge it on these grounds, but you can't force the issue or else the Judge will let the hearing proceed out of spite, hehe.

I've been clocked speeding many, many times but never pulled over for it. I think its the fact you were driving an NSX doing 55 in a 40 to get you the ticket and how you came across to the judge w/h your previous record to get slapped with the additonal stuff. OUCH!

Traffic court is different they don't have to prove anything it's a joke. It is just a proponderence sp? of the evidence. Basically if he said you were speeding your screwed. I got a speeding ticket once from a cop paceing me. I asked for a calibration record of the cars speedometer. They had none, cop admitted in court they don't do this. Guilty.

With all that was at stake, why wouldn't you use a lawyer?

honestly i didn't realize anything was a stake. i just figured at worse the judge would say guilty seen as that is all they have done before, never has a judge done this to me!!!
wonder if i can appeal the decision?
heck in Florida we have a thing that states if you get 12 points in 12 months you get it suspended. so why does the judge have to step in? seen as i don't have 12 points in 12 months......

I may be wrong but I beleive that any 3 moving violations in a 18 month period is grounds for a suspension.

You said that each time before all they did is ..... Well after a while they see that ..... is not working so they do ***** and if that does not work then they do

not directly related; but today i was on Jury Service (in Australia) ... and man, i agree there is NO JUSTICE in the courts.

It's all talk, tradition, and loopholes...

Wow! I recall getting nailed for a 96 in a 55 and getting off with a payment and traffic school. Guilty or not, that seems excessive unless you have a number of prior infractions and points on your license. You should really just talk to a lawyer and make sure there are no grounds for dismissal.

All of these questions are why you need to speak to an attorney who is familiar with the traffic courts in your jurisdiction.

Most jurisdictions will not suspend your license for a single conviction on a minor speeding violation, but will do so based on previous recent convictions.

It varies from one state to another. Some states do it based on number of violations (and the number and time period may vary), while others use a "points" system assigning points based on the severity of the violations.

Many states describe the circumstances in which they will suspend licenses on their DMV (Department of Motor Vehicles) websites. This website has links to the DMV websites in each of the fifty states.
 
i contacted my attorney but i guess i'm going to now get a bill from him but i guess under the cercumstances what options do i have? once again i guess money talks in the USA even if people scream that isn't the case, IT IS!!!!
