I got screwed in accident

I'm having the worst year of car ownership ever with my NSX this year. First, I ding things up in November. Then, yesterday, I got backed into while filling up at a gas station. The worst part is, all of the information I got from the guy (insurance, driver's license, etc) is phony, and I was too stupid to check and verify.

I decided to drive down to LA, from SF yesterday to meet my father, who had a 12 hour layover at LAX. I was planning on driving down in the morning, and driving back up at night. It's about a 5 hour drive each way, and I was really enjoying myself.

The bad news happened on my way home. I was gassing up at around 1045pm in Coalinga, CA off of I-5 and rt198. I was a bit woozy and wasn't thinking that straight. I'm filling up the car at a shell and then go in to use the bathroom. When I come out, a security guy was waiting for me by my car, along with a guy driving a 1992 Ford F-150. The driver had backed into my passenger side door, putting a large gouge into the panel.

He appeared really apologetic and immediately wrote down his insurance and driver's license information on a piece of paper. I thought about calling the police, but it was late, I had been driving a really long time and just wanted to go home, so I took the guy at face value. He seemed honest and decent and I thought I had everything I needed. *Critical note here* I didn't get the license plate of his car, stupidly. I cant believe I missed that.

So I call allstate (his and my insurance company) and his policy is bogus. I call all of the numbers he's given me, one is a fax, one is a wrong number. I look up his address on mapquest and the zip code doesn't match the city. Basically, I'm completely screwed by this guy.

The only additional piece of information I have is a driver's license number he wrote down. I dont think thats goign to be right either. I called the security guard who witnessed the accident. THe guy only works saturdays, so I'll have to call back next week, but his report didn't take down any information, except that the name of the guy he took down was william penn.

I'm gathering that I"m screwed here and am chalking it up to my stupidity for not gathering and checking the right information, but is there anything else I can do?
 
Immediately call the station and see if they have security cameras. If they do, insist that they save the tape that covers the time frame of the incident. Next, see if the guy paid by credit card and get the info from that - if the station won't co-operate call the local PD and get them involved. Giving false information is a felony. Good luck.

I would recommend that everybody should have a disposable camera in the glove compartment in the case of an accident. Take a picture of both cars with license plates, and also take a picture of the other car owner.

Sigh...I am VERY sorry to hear about the trouble you have had recently! This really breaks my heart to hear this type of thing...

I've had people back into my NSX and/or rear-end me numerous times. The first day after I moved down to Florida, a woman in a rental SUV backed into my NSX...and I saw it just as I was exiting the rental office of the apartment complex I was looking into. She saw me and started to drive away, but I ran flat right in front of her and made her stop...hey, hitting a car and driving away is one thing...manslaughter makes even idiots think twice. Anyhow...I MADE her turn off the car, exit the vehicle, and give me the keys while I called the police. It turns out that she was not on the rental policy, did not have a valid driver license, AND her b/f who rented the SUV gave false information on the rental document with regards to his insurance coverage.

SO...for this incident, I had the police report, copies of their rental policy...and I went after Thrifty Rent-A-Car as the secondary, since the primary (the loser who falsified information on the rental policy) was of no use to me. Thrifty paid up...

The second time was not too long after the first...I was sitting in the NSX eating my lunch, when I felt a bump...looked out the window and saw a HUGE SUV sharing space with my rear quarter panel. I sat on my horn as the SUV pulled away a bit, and then stopped...and I ran over to the SUV. Older woman...not paying attention...and said this to me: "I'm sorry, but there is no way anyone can see that car...it's too low." I was in NO mood to listen to that kind of garbage, so I just took down her driver license, license plate, insurance...got the same information from her passenger...and she was so "nice" as to give me her husbands business card. Again...the other insurance paid up... (I was a little sloppy in handling this incident...didn't call the police, but it was 3 days before Christmas last year, so I was being nice...or stupid? <grin>)

Anyhow...best of luck on this one...

This is no excuse. By stock, NSXs are 46 inches off the ground, which is a good 3' 10". What if a child is standing there instead of the NSX??? I don't think anyone's gonna say "I'm sorry, but there's no way to see your kid because he/she is too short"???

Anyways, sorry to hear about your incidents, byang. I'm sure justice will be served....
 
so the irony is that I ALWAYS keep a disposable camera in my glove compartment for just such an occasion. While in LA, I wanted to take some pictures with my dad, so I thought "hey, how fortuitous, I have a disposable camera in my glove compartment." So we took some pictures and he went back home to virginia with the camera. sigh. c'est la vie.

I found out that it falls under the collision part of my insurance, so I'm out a $500 deductible and my rates may go up. I've already filed another claim in November for an accident that WAS my fault. All I need now is for my insurance to get cancelled.
